What Does TRPA Regulate for Lake Tahoe Property Owners? Remodels, Trees, Coverage, BMPs and Buoys (2026)

Real Estate Tahoe's short answer: TRPA regulates six things on a Tahoe Basin parcel: how much of the lot can be covered by anything hard (land coverage), the stormwater controls every developed lot must have (BMPs), what happens in the shorezone (piers, buoys), trees and vegetation, the look of anything visible from the lake or a scenic road (height, colors, reflectivity, lighting) and when you can dig (no grading October 15 to May 1). It does not regulate short-term rentals, which the counties and the City of South Lake Tahoe permit, and it does not inspect defensible space, which the fire districts do. Real Estate Tahoe's brokers pull the TRPA parcel record on every listing and every purchase, so the coverage number, the BMP status and any open violation are known before the price is set.

What you can do without asking, what needs a declaration, what needs a permit

Exempt: no notice to TRPA if no coverage is added or moved

Per Code section 2.3.2:

  • Interior remodeling with no change of use.
  • Painting, non-metallic re-roofing, new windows, siding and doors, exterior structural repair under $50,000 a year without enlarging.
  • Fence repair outside a stream environment zone, or a new fence up to six feet that keeps the public's lake view.
  • Digging up to three cubic yards within 48 hours; landscaping outside the SEZ from the TRPA plant list.
  • Live trees 14 inches diameter at breast height or less off the lakeshore; dead trees to 30 inches west side, snags to 24 inches east side.
  • Seasonal lights Thanksgiving to March 1; an approved woodstove swap; demolishing a structure under 50 years old.

Qualified Exempt: an online declaration three working days ahead

The Qualified Exempt declaration costs $233, or $397 in the shorezone, no IT surcharge:

  • A remodel or addition that adds or relocates no coverage, with a BMP retrofit plan.
  • A shed, hot tub, generator or greenhouse up to 120 square feet or 2% of the non-sensitive land, whichever is less, on a parcel with a BMP certificate and verified coverage.
  • A non-glare earthtone metal roof more than 300 feet from the lake; non-reflective roof-mounted solar.
  • Swapping asphalt or concrete for pervious pavers, a partial coverage exemption up to 10 percent of the non-sensitive land; pervious asphalt does not qualify.

Permit required

  • Anything that adds or moves coverage: a house, a new deck, a paver patio or new driveway paving.
  • Retaining walls, only to stabilize an existing unstable cut or fill; walls under 12 inches are exempt up to 1% of the parcel.
  • Live trees over 14 inches dbh, or six inches on a lakefront parcel where they screen.
  • Any shorezone structure or project visible from the lake.

Land coverage for an owner

Base allowable coverage follows the Bailey land capability class under Code Table 30.4.1-1; lots built after 1987 use an IPES score, and 726 or higher counts as non-sensitive.

Coverage can be bought and moved onto your parcel at 1:1 from an equal or more sensitive parcel, usually within the same hydrologic area; the transfer fee is $913. A parcel over its allowance enters the excess-coverage mitigation program with any project: remove coverage on site, retire it elsewhere, or pay the 2026 fee per square foot, $20 in Incline Village, $25 at Cave Rock, $18 in Agate Bay NV, $15 in South Stateline NV, $12 at Marlette and $8.50 in the California hydrologic areas. Unverified parcels first pay for a Land Capability Verification ($708 minimum) or a Coverage Verification ($911).

TRPA's January 2026 policy recommendations would allow more coverage for town-center and mixed-use projects and revisit incentives that disincentivize overcoverage on large market-rate homes. Scoping closed March 16 2026 and nothing is adopted for single-family parcels.

BMPs: the stormwater work every developed lot owes

TRPA requires all developed properties to install and maintain BMPs; every deadline expired October 15 2008 and the real-estate disclaimer puts fines at up to $5,000 per day. After final inspection TRPA issues a certificate, searchable at tahoebmp.org. Three things owners miss: any project triggers a retrofit of the whole parcel (Code 60.4.3.B.2); BMPs must be maintained (Code 60.4.9) or the certificate lapses; and the buyer files the BMP disclosure form with TRPA within 30 days of a sale (Code 60.4.4.C). Trees

The line is 14 inches diameter at breast height. At or under it, off the lakeshore, a live tree comes down with no notice; over it you need a TRPA permit, $91 minimum plus $91 per hour. On lakefront parcels the line drops to six inches where trees screen the house (Code 61.1.5). An emergency tree may come down at once, with photographs, paperwork and fees due within ten working days (Code 61.1.4.A.2). Defensible-space cutting is not TRPA's call; the local fire protection agency permits it. The City of South Lake Tahoe does not conduct defensible tree permits, so SLT owners go to TRPA.

Shorezone: buoys and piers

No mooring buoy may be placed or kept without a TRPA permit (Code 82.7.3), and each carries a TRPA tag. A parcel may have two, 50 feet from other buoys and 20 feet from projected lot lines (Code 84.3.3.D). Registration renews yearly at the mooring portal, $43 plus $47 scenic mitigation. An existing buoy is eligible if it had a TRPA permit, a state lease, or pre-dates 1972; unauthorized moorings may face penalties. The 2018 Shoreline Plan allows up to 1,486 new private moorings, $1,581 per application. A new pier starts at $6,623 plus $60 a foot.

Scenic, height, setbacks, lighting and the grading season

If the home is visible from the lake or a scenic road, scenic standards apply; if not, they do not. Where they apply: primary color a subdued earthtone, Munsell value and chroma 0 to 4 (Code 36.6.1.D); glass no more than 11 percent reflectivity (Code 66.1.6.A); string lights, roofline tube lighting and reflective walls prohibited, fixtures shielded (Code 36.8.1); decks 20 feet back from a scenic roadway (Code 36.5.4.A). Nothing goes in a stream environment zone setback (Code 53.9.3). Height runs from 24 feet on a flat lot to 42 feet with a steep pitch on a slope (Table 37.4.1-1). Grading is closed October 15 to May 1 unless TRPA approves (Code 33.3.1.A); the residential exception is $102, emergencies only.

Enforcement: what a violation costs and who inherits it

The civil penalty is up to $5,000 plus up to $5,000 per day. A Notice of Violation gives the owner 21 calendar days to respond under the Rules of Procedure. Work that could have been permitted is legalized after the fact at double fees under the Permitting Procedure Manual; anything else goes to a Governing Board settlement, and illegal coverage must be removed before the parcel can use any exemption. So a violation follows the parcel to the next owner.

Who you actually apply to

Delegation MOUs hand TRPA's permitting to a local government: South Lake Tahoe, El Dorado County and Placer County hold active ones, so a California-side owner files with the city or county. The Washoe County MOU has been inactive since 2023 and both Douglas County MOUs are inactive, so Incline Village, Crystal Bay, Stateline, Zephyr Cove, Glenbrook and Round Hill owners file with TRPA directly. Anything visible from the lake or a main travel route, and all shorezone work, goes to TRPA itself. TRPA and short-term rentals

TRPA does not permit short-term rentals; it delegates that to the counties and the city; each program is on our Lake Tahoe STR rules hub. Can I put in a hot tub without a TRPA permit?

Usually, through a Qualified Exempt declaration rather than a permit. A hot tub, shed, generator or greenhouse up to 120 square feet or 2% of the non-sensitive land, whichever is less, qualifies if the parcel has a BMP certificate and verified coverage. What happens if the previous owner did unpermitted work?

The Notice of Violation goes to whoever owns the parcel, so the problem is yours. Work that could have been permitted is legalized at double fees; anything else goes to a settlement, with penalties up to $5,000 plus $5,000 per day. Does TRPA control whether I can rent my house on Airbnb?

No. TRPA delegates short-term rental permitting to the counties and the City of South Lake Tahoe, so the rules and caps come from Placer, El Dorado, Washoe, Douglas or the city. A permit never transfers to a buyer, and in Incline Village 61 of the 144 HOAs Real Estate Tahoe tracks prohibit short-term rentals.
