Real Estate Tahoe's short answer: a Lake Tahoe home can legally be an Airbnb only if it clears five layers at once: (1) the jurisdiction still issues permits (three do today without a waitlist), (2) the zoning and the parcel qualify (residential zones in South Lake Tahoe are capped, El Dorado County has 500-foot buffers, Douglas County has a 15% neighborhood density limit), (3) the property type is allowed (no ADUs anywhere, no tiny or manufactured homes in Placer County and Truckee, condos only where the HOA permits), (4) the HOA or CC&Rs allow it (the county never overrides them, and 61 of the 144 Incline Village associations Real Estate Tahoe tracks say no), and (5) the owner can meet the permit conditions (fire inspection, parking-based occupancy, bear box, local responder, use-per-year rules). Real Estate Tahoe checks all five for every buyer before the offer, and its home search shows the verdict on each listing.
The five layers every Lake Tahoe Airbnb has to clear
Lake Tahoe spans two states and seven permitting jurisdictions, each with its own version of the same five tests. A house that passes four of them is not an Airbnb.

Layer 1: does the jurisdiction still issue permits?
As of September 18 2026, three jurisdictions take applications without a waitlist. Placer County is open under a 3,900-permit cap; Real Estate Tahoe mirrors the county registry and counted 3,393 active permits on September 16 2026. Washoe County (Incline Village, Crystal Bay) has no cap. Unincorporated Nevada County requires only a TOT certificate. The other four are constrained: South Lake Tahoe began waitlisting residential applications on August 21 2026; Truckee is at its 1,255 cap; El Dorado County caps the Basin at 900; Douglas County (Stateline, Zephyr Cove) has issued 560 of 600. One rule holds everywhere: no jurisdiction lets a buyer apply before owning the home, and permits never transfer on sale. Douglas County voids the permit when title changes; Washoe's FAQ says "the new owner must apply for a new permit." A seller's permit conveys nothing, which is why selling a home with an STR permit is about documentation.
Layer 2: zoning and parcel rules by jurisdiction
- South Lake Tahoe (CA): the cap applies to Residential zones; Tourist Core and Commercial zones are not impacted. Hosted rentals with the owner on site are outside the cap; the VHR buffer was removed in 2026.
- El Dorado County Basin (Meyers, Tahoe Paradise, CA): parcels within the 500-foot buffer of an active VHR are not eligible; the county is reviewing the ordinance and the buffer remains.
- Placer County (CA): all zone districts that allow residential use; one STR per property, up to four in town centers; deed-restricted units excluded.
- Truckee (CA): all residential zones, but no application within 365 days of the most recent change of ownership.
- Washoe County (NV): Tier 1 (10 or fewer occupants) in all residential zones; Tier 2 (11 to 20) by Administrative Review Permit; Tier 3 (21 and up) only in hotel zones.
- Douglas County Tahoe Township (NV): permits follow zoning, one per applicant owner, and VHRs may not exceed 15% of dwelling units in a residential community; many neighborhoods are Full.
Layer 3: is the property type allowed?
Every Tahoe jurisdiction has closed ADUs to new short-term rental use, so a "house plus rentable ADU" listing cannot be permitted.

Layer 4: the HOA and CC&Rs
This layer kills the most deals in Incline Village, Crystal Bay and the gated Northstar-style communities, and no county permit page will warn you. Washoe County's FAQ says the county "does not enter, nor enforce these private covenants" and cannot stop an association from prohibiting short-term rentals. Douglas County will not issue a permit where it knows the HOA prohibits VHRs. Everywhere, the permit sits underneath the covenants.

How to read the CC&Rs
Read the recorded declaration, every amendment, and the current rules, in that order, looking for a minimum lease term and for "transient", "hotel" or "commercial use", and get the manager's answer in writing. On the Real Estate Tahoe home search, "verify with HOA" is a prompt to ask, not a green light.
Layer 5: permit conditions that disqualify a specific house
Parking and occupancy
South Lake Tahoe sets occupancy by paved parking spaces and bedrooms; garage parking does not count. Washoe County requires one space per four occupants. El Dorado County requires two on-site spaces, with occupancy at two per bedroom plus two. Douglas County allows two per bedroom, plus two if four bedrooms or fewer, with a space per four occupants. A two-car driveway often means a six-guest permit, which changes the math in our investment guide.
Fire inspections, bear storage and the local contact
Placer County requires a passing defensible space inspection on file at all times. El Dorado County inspects every other year. Truckee Fire charges $500 every three years. Washoe sends NLTFPD to every Incline and Crystal Bay application. Tahoe Douglas Fire inspects at $250. A steep, heavily treed lot can fail. Bear-resistant trash storage is mandatory everywhere, and most permits require a local contact for complaints; check the county's details.
Use-per-year rules and the Truckee clock
Placer County requires each STR to rent at least 30 nights per year once the 3,900 cap is reached, excluding owner-occupied STRs. El Dorado County requires 10 rented nights per year. Douglas County adopted an eight-night-per-year rule in December 2025, per the Record-Courier. None of these is a minimum length of stay; Washoe has no minimum at all. In Truckee, a buyer closing today cannot apply until September 2027.
How to check a specific address in about 20 minutes
- Jurisdiction (2 minutes): city or county, Placer or Truckee, Washoe or Douglas; 463 active Placer permits carry Truckee addresses.
- Zoning and parcel (5 minutes): county GIS zoning; El Dorado's buffer map; Douglas's density list; South Lake Tahoe's zone.
- Property type (3 minutes): assessor record and permit history for any ADU.
- CC&Rs (5 minutes to start): declaration, amendments and rules; in Incline Village, our HOA table first.
- Availability (2 minutes): the tracker.
- Fire district (3 minutes): who inspects and whether the lot passes.

What TRPA does and does not decide
The Tahoe Regional Planning Agency does not issue, cap or deny STR permits. Its housing webinar Q&A states that STR regulation is delegated to local governments, listed on its neighborhood compatibility page. TRPA does regulate the physical property inside the Basin, including land coverage, runoff controls, buoys and tree removal, which affect the house but not the permit; Truckee sits outside the Basin. Frequently asked questions
Which Lake Tahoe properties can legally be used as an Airbnb?
Only properties that clear all five layers: a jurisdiction still issuing permits, an eligible zone and parcel, an allowed property type, an HOA that does not prohibit rentals, and a house that meets parking, fire, bear storage and use-per-year conditions. Today Placer, Washoe and unincorporated Nevada County take applications without a waitlist; the other four are capped or waitlisted. Can I buy a home that already has an STR permit and keep using it?
No. In all seven Lake Tahoe jurisdictions the permit ends with the sale and the new owner applies from scratch. Douglas County voids the permit when title changes, and Washoe County's FAQ says the new owner must apply for a new permit. The seller's permit is evidence the house passed once, not an asset you are buying.
Are ADUs allowed as short-term rentals anywhere at Lake Tahoe?
Not for new permits. South Lake Tahoe prohibits renting an ADU for 30 days or less, El Dorado County bars VHRs in second units, Placer County closed ADUs on April 1 2025, Truckee issues no new ADU certificates, Washoe County banned them in the Tahoe planning area in 2024, and Nevada County ADUs built after April 25 2019 carry a deed restriction.
Does my HOA matter if the county will issue the permit?
Yes, more than the county does. Washoe County says it does not enforce private covenants and that its ordinance does not change an association's right to prohibit short-term rentals. Douglas County will not issue a permit where it knows the HOA prohibits VHRs. Of the 144 Incline Village and Crystal Bay associations Real Estate Tahoe tracks, 61 prohibit short-term rentals.
